In 2012, there were efforts to form a casino in Georgia. Potentially, this could have led to Georgia sports betting becoming available at its location. In addition, this casino would fund an education program in the state. The efforts to build this casino, however, did not succeed. Since then, there have been few attempts to legalize casino gaming in Georgia. It is, therefore, currently illegal to offer casino gaming or other forms of gambling in the state.

In 2018, the Supreme Court ruled to allow states to offer sports betting if they so choose by repealing the Professional and Amateur Sports Protection Act of 1992. As a result, Georgia was initially hesitant to move ahead with any legislative changes to legalize Georgia sports betting. In February 2020, however, five senators supported SB 403 after they saw that Tennessee legalized sports betting. Sb 403 would make Georgia sports betting legal. Ultimately, however, it was unsuccessful, and Georgia sports betting remained outlawed.

Nearly a year later, in January 2021, HB 86 was put forward. The bill, called the Georgia Lottery Mobile Sports Wagering Integrity Act, did not receive enough support. In March 2022, the state had the opportunity to legalize Georgia sports betting by the year 2022 after two bills were passed. DraftKings was preparing for the possibility of a launch in Georgia. In March 2022, lawmakers did a last-minute attempt to legalize Georgia sports betting, even though there was only one week left of the year’s legislative session. The Georgia House Economic Development and Tourism committee passed SR 135 and SB 142.

In the end, however, lawmakers did not approve Georgia sports betting on time. Time ran out, and the next opportunity to revisit the Georgia sports betting issue will be during the 2023 legislative session in Georgia. However, North Carolina lawmakers have progressed in their steps to legalize North Carolina sports betting, so sports betting may soon be available in the nearby state. In addition, Tennessee is Georgia’s neighbor that permits sports betting.

The residents of Georgia may still be able to enjoy some forms of gambling without breaking the law. Lottery betting remains legal. Laws have also been introduced in 2018 to legalize Daily Fantasy Sports, also called DFS, in the Peach State. Unfortunately, the Senate still has not approved this legislation. However, as Daily Fantasy Sports (DFS) are technically considered skill-based sports, there is no legislation against them in the state of Georgia.

When the 2023 legislation approaches, there will be a new chance to legalize Georgia sports betting, and Georgia sports betting could still become available in the coming years.
